Conditions of Rental

All vehicles are rented subject to Avis Terms and Conditions of the Rental Agreement which must be signed by all renters. This site is for information purposes only.


Rates
:: Rates include unlimited mileage, collision damage waiver, theft loss waiver, personal accident insurance, maps, tourism levy, airport surcharge, and VAT.
:: Rates exclude windscreen breakage, fuel, delivery and collection fees.


Minimum Rental Period
:: Rates are calculated from time of pick-up to time of drop-off, with the minimum rental period being 24 hours.

Value Added Tax

:: All rates quoted are inclusive of VAT except on the copy of the rental agreement. The rental agreement that will be issued at time of check-out/collection will reflect the rate excluding VAT, with the VAT amount appearing separately in box 55.


Terms of Payment

:: Recognised bank charge cards - American Express, Diners Card, Visa and MasterCard's are acceptable methods of payment.
Passport/Identification

:: The renter and additional driver are obliged to present either a valid passport or valid recognised country identification at the time of check-out/collection.


Minimum Rental Age

:: The renter and any additional drivers must be 25 years of age and have been in possession of a driver's licence for a minimum of 5 years.
:: The renter and any additional driver can be 21 years of age if in possession of a Diners or American Express credit card, which must be used to settle the account. This is subject to an additional levy being charged of R350.00 per rental day for every renter / driver over 21 years of age and under 25 years of age.
:: Please note all rentals where the driver is under 25 years of age will be subject to the discretion of management.

Drivers Licence
:: The renter is obligated to inform Avis Luxury Cars of an additional driver. The driver is subject to the same licence conditions as the renter. (If Avis Luxury Cars is not informed, all waivers accepted will become null and void).
:: Driver's licences must be valid for a minimum period of 5 years. It is a legal requirement in South Africa for driver's to be in possession of their original driver's licence at all times whilst driving a vehicle.

Additional Driver Fee

All drivers must be listed on the applicable rental agreement. There is a charge of R225 per additional driver, per rental. If Avis Luxury Cars is not informed, all waivers will become null and void and the full costs of any loss/damage will be charged.


Rental Contract Fee

A R30 contract fee is payable by the client at the time of vehicle collection. This is an administration fee to cover administration costs and will apply to each rental.

Petrol

This is not included in the rates. Cars are delivered full and customers are charged for refuelling the vehicle upon termination of the rental.
Delivery and Collection Charges
Please refer to the Delivery and Collection Fees page. If the destination is not on the attached table the rates will be subject to the written quotation supplied. Please note that the only destinations that do not attract a delivery / collection fee is when a vehicle is rented and returned from the same listed International Airports - Cape Town, Johannesburg and Durban.
Renters are also entitled to one complimentary point-to-point (less than 30km) transfer upon either collection or drop-off.

Authorisation for the above amounts will be collected from the bank 24-hours prior to collection. The actual debit to the credit card will be done after termination of the rental.


Traffic Fine Handling Fee
In the event of any traffic offence taking place during the rental the driver must be aware that an NDC form (the affadavit required by the Department of Transport) will be completed to transfer the fine and penalty points to the individual. A fine administration fee of R150 will be charged in each instance.
No Shows & Cancellations

:: All confirmed bookings that are cancelled 7 days or less prior to the collection date will be subject to a cancellation fee. The fee will be the equivalent of 2-days rental

:: All no-shows that are not cancelled in writing will be billed for the full hire amount.

:: Once the rental has commenced the number of rental days confirmed will be billed irrespective of whether the rental is terminated earlier than reserved. No refund will be processed in this case.


Special Equipment & Services
Various additional services are available from Avis Luxury Cars. The services are subject to availability. Please enquire. Baby Seats are available at R250.00 per rental.
Waivers
Rates include limited coverage of passenger liability and third party motor liability. Such cover being subject to the terms and conditions of the Avis policy and insurance as is customary in South Africa / Swaziland and Lesotho. Cover for loss by fire is also included together with cover for damage to the Avis car, excluding the applicable responsibility, but does not include loss or damage through incidents of civil unrest. Insurance does not cover personal property.
If Collision Damage Waiver and/or Theft Loss Waiver are not taken, Avis Luxury Cars will require an additional deposit to cover the full excess as laid out in the standard rates.

Collision Damage Waiver and Theft Loss Waiver
The rates include coverage of Collision Damage Waiver and Theft Loss Waiver. However, a non-waiverable responsibility will be levied in the event of damage to the vehicle and/or part thereof as a result of collision, or theft of the vehicle or part thereof.
Please note that the applicable cover will fall away completely if:
:: At the time of the damage and/or theft, the driver of the vehicle is under the influence of alcohol, illegal or banned substances.
:: The damage and/or theft was caused by the fault or negligence of the renter and/or driver of the vehicle.
:: The damage and/or theft occurred in a situation where no other vehicle or animal or object was involved.
:: The driver of the car at the time of the damage and / or theft is not an official authorised "additional driver" recorded on the rental documentation.
:: If vehicles are taken into countries out of South Africa without written authorisation from Avis Luxury Cars, the renter will be responsible for the full value of damage to the vehicle. In the case of theft the renter will be responsible for the full value of the vehicle based on the current market value of the vehicle in the country where the theft took place.
:: If sedan vehicles are driven on a road which is not tarred or generally where the road condition was not suitable for the vehicle.
:: If 4x4 vehicles are driven on a road which condition was not suitable for the vehicle.
:: If at the time of the damage the driver of the vehicle was exceeding the speed limit-the vehicle management system will be used to determine this and provide evidence in court.

Personal Accident Insurance
Avis Personal Accident Insurance covers the driver as well as all other passengers for accidental bodily injury while driving, riding in, getting into or out of the Avis Luxury Cars vehicle. Coverage is in effect up to "the return date" indicated on the Rental Agreement or any approved extension.

:: The insurance will apply to persons up to the age of 75.
:: The death benefit in respect of persons under 15 years of age shall be limited to R10 000.
:: Payout is limited to R200 000 per person and R500 000 per Avis vehicle.

Passenger Liability and Third Party Motor Cover

::Total Cover
The total cover is for R200 000 000. This applies to Avis Luxury Car vehicles registered in South Africa travelling in South Africa. It excludes cover in ALL other countries.
:: Passenger Liability - Third Party Claims
Avis Luxury Cars Rental Agreement covers the renter and any other authorised driver against any claims which they become legally liable to pay consequent upon accidental death of or bodily injury or illness or accidental loss of or physical damage to tangible property resulting from the negligence of the renter or authorized driver whilst driving the hired vehicle.

Main Exclusions
If any of the following circumstances below are applicable at the time of damage to the Third Party, the renter or driver will not be covered by the policy:

:: The rented vehicle was not in a roadworthy condition.
:: The accident/damage occurs while driving beyond the acceptable road or thoroughfare conditions.
:: The driver was under the influence of liquor/drugs.
:: The driver was not holding a valid drivers licence.
:: Carriage of fare-paying passengers.
:: Carriage of passengers in excess of the particular vehicles capacity.
:: Death of or bodily injury to any person in the employment of the renter/driver arising from in the course of such employment.
:: Death of or bodily injury to a member of the same family/household as the renter/driver (spouse or child).
:: The Renter/Driver is not entitled to indemnity under any other policy.
:: The Renter/Driver has not been refused motor vehicle insurance by any insurance company/underwriter.
::The Renter/Driver will not be covered for any consequential losses or damage or for contractual liability unless such liability would have attached notwithstanding any contractual agreement.
:: Furthermore, the benefits of the policy are not available where the renter is in breach of the contract, and the Renter/Driver must notify Avis Luxury Cars of all losses immediately upon becoming aware of the incident. Theft or other criminal acts must be notified to the police immediately.
:: In accordance with South African law all Third Party claims are first processed via the Road Accident Fund (56 of 1996). Should the Road Accident Fund not fully honour the claims, the Avis Policy will come into effect.


Over Border Rentals
No vehicles from the Avis Luxury Cars fleet may be taken outside of South African borders. If a vehicle is taken outside of the borders of South Africa insurance waivers will become null and void. The renter of the vehicle will then be responsible for the full cost of any damage caused by accident, break-ins, or third party as well as all passenger liability claims. In the case of theft of the vehicle, the renter will be responsible for the replacement of the vehicle at the current market value of the vehicle in the country in which the theft took place. Avis Luxury Cars reserves the right to invoke breach of contract in this case.
Accident Management
In the event of an accident, the driver of the vehicle is obliged to inform Avis Luxury Cars within 6 hours of the incident. Under no circumstances may the driver or the renter arrange to have the vehicle towed from the scene of the accident without prior arrangement with Avis Luxury Cars. Avis Luxury Cars will need a detailed accident report from the driver/renter as well as information about the other vehicles involved in the accident with names of witnesses and the police station at which the accident was reported. An accident administration fee of R500 will be charged per incident.
